1 - PARTIES: This Agreement is entered into between BEAUTYLOGY TRAINING COMPANY, whose registered address is Tallinn, Lasnamae Linnaosa, Majaka tn 26 / Estonia (hereinafter referred to as "NAILACADEMY TRAINING" or "Seller") and the person shopping on the Seller's website (hereinafter referred to as "Buyer").
When the Seller and the Buyer are referred to separately, the term "Party" will be used; when referred to together, the term "Parties" will be used.

2- SUBJECT OF THE CONTRACT: The subject of this Agreement; It regulates the rights and obligations of the Parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts in relation to the sale, delivery, return, dispute situations regarding the sale, delivery, return, dispute situations of the training specified on the Seller's website with the features of the training ordered by the Buyer to the Seller via remote communication. The Parties agree that the duration of the trainings to be offered to the Buyer under this Agreement, the name of the instructor, the type of training, the training sales price is as stated on the NAILACADEMY TRAINING website.

3- TERMS OF USE: Before using the service, the Buyer undertakes that he / she has carefully read and approved this Distance Sales Agreement and all of the Terms of Use on https://nailacademy.org/terms_of_use and that he / she will adhere to all the conditions in the aforementioned documents.

4- PAYMENT METHOD: Training programs can be purchased by credit card or EFT / Money Order method through the NAILACADEMY EDUCATION website. The prices listed and announced on the NAILACADEMY EDUCATION website are the sales price. The advertised prices are valid until they are updated and changed by NAILACADEMY EDUCATION. Prices announced for a period of time are valid until the end of the specified period.

If the product / service subject to the contract will be delivered to the Buyer with a material (CD, DVD, FLASHBELLEK, HARD DISK, etc.) that can be shipped in line with the demands of the buyer, the shipping fee for the shipment will be paid by the Buyer and is not included in the product / service price. The provisions regarding delivery shall be valid only in cases where shipment is requested, and delivery by shipment is not subject to the contract in cases where the service / product will be performed instantly via digital data.

The Seller accepts, declares and undertakes that if the Seller cannot deliver the training subject to the
Contract within the period due to force majeure circumstances that develop outside the will of the Parties, it will notify the Buyer. The Buyer also has the right to request from the Seller to cancel the order, to replace the service subject to the Contract with its equivalent, if any, and / or to postpone the service delivery period until the elimination of the preventive situation. If the order is canceled by the Buyer, the product amount shall be paid to the Buyer in cash and in cash within 14 days for payments made by the Buyer in cash. For payments made by the Buyer by credit card, the product amount shall be returned to the relevant bank within 14 days after the order is canceled by the Buyer. The Buyer accepts that the Seller will not have any responsibility for the process of reflecting the amount in the Buyer's accounts after the return of the said amount to the relevant bank by the Seller.

5- RIGHT OF WITHDRAWAL: Buyer; Within the scope of the Regulation on Distance Contracts published in the Official Gazette dated November 27, 2014 and numbered 29188, published in the Official Gazette dated November 27, 2014 and numbered 29188, the Buyer has understood and accepted that the contracts for services performed instantly in electronic media or intangible goods delivered to the consumer instantly are considered as exceptions to the right of withdrawal and in this context, online trainings (including digital training contents) will not be returned or canceled. However, the Buyer has the right to cancel the training and request a refund by notifying NAILACADEMY TRAINING 14 days in advance, as long as no subject in the relevant training has been started and the training in question has not been purchased with any campaign. In exercising the right of withdrawal, the Buyer may send an e-mail to support@nailacademy.org with a clear statement stating the decision to withdraw.

6- PRIVACY POLICY: The Buyer undertakes that he/she has carefully read and approved the entire Privacy Policy on https://nailacademy.org/privacy-policy before using the service and undertakes to adhere to all conditions in the aforementioned documents.

The Seller has the right to reach the Buyer for communication, marketing, notification and other purposes by letter, e-mail, SMS, phone call and other means through the address, e-mail address, fixed and mobile telephone lines and other contact information specified by the Buyer in the registration form on the site or subsequently updated by the Buyer. By accepting this contract, the Buyer accepts and declares that the Seller may engage in the above-mentioned communication activities for him.

7- INFORMATION ABOUT THE PROTECTION OF PERSONAL DATA: Before using the service, the Buyer undertakes that he / she has carefully read and approved the entire Privacy Policy at https://nailacademy.org/privacy-policy, which contains detailed information on how his / her Personal Data is protected, stored, processed by Nailacademy Education and the rights of the data owner regarding them, and that he / she will adhere to all the conditions in the aforementioned documents. In accordance with the Personal Data Protection Law No. 6698, the Buyer confirms that he / she has been informed about the purpose for which his / her personal data will be processed by Nailacademy Education, to whom and for what purpose the processed personal data can be transferred, the method and legal reason for collecting personal data and my other rights listed in Article 11 of the aforementioned Law.

In this context, the Buyer agrees that Nailacademy Education's https://nailacademy.org/privacy-policy address of Nailacademy the personal data and related documents will be recorded in the data recording systems of Nailacademy and classified in these systems and stored for the period stipulated by the legislation, The Buyer hereby freely consents to be used at every stage and in every transaction where the requirements of this Agreement will be fulfilled, to be shared with third parties from whom it receives services within the scope of the provision of services, contracted institutions for the realization of after-sales services, relevant agencies, real and legal persons with whom Nailacademy Education has a proxy relationship, authorized judicial and administrative authorities in accordance with legal obligations.

In addition, the Buyer declares and undertakes that the personal and other information provided by the Seller while becoming a member of the Seller's website is in accordance with the truth, and that the Seller will compensate all damages that the Seller may incur due to the untruthfulness of this information immediately, in cash and in full upon the first notification of the Seller.

8- PROHIBITION OF TRANSFER: The Buyer may not transfer and/or assign its rights and obligations arising from this Agreement for any purpose without the consent and approval of the Seller.
9- APPLICABLE LAW - PLACE OF DISPUTE RESOLUTION: This Agreement shall be governed by the legislation of the Republic of Turkey and shall be interpreted in accordance with the legislation of the Estonia. The Parties agree that Estonia Courts and Enforcement Offices shall be competent for the resolution of any dispute, controversy, contradiction arising out of or relating to the validity of this Agreement or arising out of or relating to this Agreement or its breach.

10- ENFORCEMENT: The Buyer is deemed to have accepted all the terms of this Agreement when the Buyer makes the payment for the order placed on the Nailacademy website.
