It should be especially noted that: NAILACADEMY is NOT a traditional educational institution and is not intended to function as such. Our mission is to help our users towards professional transformation and to do so by offering close online collaboration between the speaker and the course participants. You need an account ("User Account") for most activities on NAILACADEMY, including subscribing and registering for a course or training offered on the Website.

If you are younger than the required age, you will not be able to create a User Account; however, we recommend that you invite a parent or guardian to create a User Account and help you register for courses that are appropriate for you. If we determine that you are younger than the age required in your country to use the online services but have created a User Account, your User Account will be terminated.

WHERE NAILACADEMY HAS PROVIDED YOU WITH THE ABILITY TO CREATE A USER ACCOUNT, YOU AGREE THAT YOU WILL HAVE NO OWNERSHIP OR PROPRIETARY RIGHTS IN THE USER ACCOUNT AND THAT ALL RIGHTS IN AND TO ANY USER ACCOUNT OR USER PROFILE BELONG TO NAILACADEMY, YOU ACKNOWLEDGE AND AGREE THAT NAILACADEMY SHALL AT ALL TIMES REMAIN THE PROPERTY OF NAILACADEMY AND SHALL PREVAIL IN FAVOR OF NAILACADEMY.

You must provide us with complete, accurate and up-to-date information (including your e-mail address) when creating and using your User Account and keep your personal data accurate and up-to-date at all times. You may request deletion of your User Account by sending an email request to our Support Team. Please note that if you request deletion of your User Account, you may no longer be able to access and use the Services and any content you have submitted to us.

NAILACADEMY does not and will not accept any assignment of your User Account or user profile. Note that the Course Content belongs to the speaker and NAILACADEMY and is not transferred or assigned to you under any circumstances by virtue of your enrollment.

For the purposes of this agreement, the term "Content" means literary works, texts, lectures, presentations, speeches, computer programs, mobile programs and applications, as well as audio and visual works (video courses, infographics, phonograms, images, trademarks and service marks), trade names and trade names, trademarks, logos, hypertext links and parts thereof, information, widgets and other objects or materials published on the Website or within the Course, including subjects of intellectual activity and equivalent means of personalization.

When you enroll in a Course, you are granted the right to view the Course on the Website, subject to your payment in full of the fees associated with the Course. You are granted a license to the Courses, but the Courses are not sold to you. This means that you are legally granted a limited, personal, non-exclusive, non-transferable license to access and view the Courses (and related Content) through our Website solely for your personal, non-commercial, informational purposes, all in accordance with these Terms of Use and any conditions or restrictions specifically associated with such particular Course. The right to view the Course does not entitle you to download and/or resell the Course in any way, including sharing your User Account information, illegally downloading and/or sharing the Course in any way. You are provided with one year's access to the course recording, which they can access through their User Account. This means that the Course link will be active in your User Account for this period from the start date of the Course and you will be able to view the recording an unlimited number of times. You consent to NAILACADEMY using the above information to analyze trends, administer our Website, track users' movements and gather broad demographic information for statistical purposes.
By enrolling in a Course, you expressly agree that we may collect, use, store and otherwise process your personal data for the purpose of providing you access to the Course and related activities and communications in which you agree to participate. NAILACADEMY does not control what Users and their speakers do with information they obtain from other Users during our Courses or otherwise. For your security, you are advised not to share your email and/or other personal information.

Certain Courses allow you to ask questions of speakers and submit reviews of courses. For certain Courses, speakers may ask you to submit content as "homework" or quizzes. You are advised not to submit anything that is not your own.

NAILACADEMY offers Courses for a fee. By subscribing to a Course, you agree to the pricing, payment and billing policies applicable to such fees and payments as described on the Website or in any policy of a third party payment service. By continuing to pay for the Course you have subscribed to, you authorize us to charge your debit or credit card (or process other payment methods) for the full fee applicable to the Course you have selected.

You agree to pay all fees incurred by you, including applicable taxes, in accordance with these Terms of Use and the billing terms in effect on the date the fee is due or payment is made. Please note that as a general rule, payment for the Course you have subscribed to is due no later than one day before the start date of the Course.

You acknowledge that NAILACADEMY may use certain third party providers (such as PayPal, Stripe, Square, etc.) to collect or otherwise process such fees or payments. Any additional and separate fees or obligations you incur directly with such third party are your sole responsibility. When you pay for a subscription, you agree not to use an invalid or unauthorized payment method.

PAYMENT FOR ANY SUBSCRIPTION/MEMBERSHIP IS FINAL AND YOUR PAYMENT WILL NOT BE TRANSFERRED OR REFUNDED UNDER ANY CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, TERMINATION OF YOUR USE OF OUR SERVICES FOR ANY REASON OR NO REASON, TERMINATION OF THIS AGREEMENT, AND/OR TERMINATION OF THE SERVICES.

When you purchase a Course subscription, you agree not to use an invalid or unauthorized payment method. Any use of such invalid or unauthorized payment methods will, in our sole and absolute discretion, allow us to cancel payment. Unless otherwise stated, all fees are in TRY, USD, EURO.

Your interaction with other Users (including, for the purposes of this section, Course speakers), whether online or offline, is solely at your own risk. You acknowledge and agree that NAILACADEMY is not responsible or liable for the conduct of any User.

Your conduct while using our Services is solely your responsibility, and you agree that you will not post, submit, upload, transmit, transmit, distribute, disseminate or otherwise make available to any User or speaker the following:

- material that is determined in NAILACADEMY's sole discretion to be harmful, abusive, defamatory, libelous, obscene, infringing, embarrassing, undesirable, invasive of the privacy rights or publicity of others, hateful, or racially, ethnically or otherwise offensive, objectionable or otherwise inappropriate;

- material that promotes or influences other criminal activity (including against people, animals and property);
- material or information that infringes any copyright, trademark, patent, trade secret, privacy, publicity or other rights of others;

- files that contain any malicious code, including viruses, spyware, Trojan horses, worms, time bombs, cancelbot, corrupted data, or that could in any way damage or interfere with the operation of the Website and Services, other Users' and speakers' access to the Website or Services and/or Users' and speakers' computers;

- material that contains pornographic images or text or that may be offensive to minors;
- pyramid schemes, chain letters, unsolicited e-mail, spam or messages sent without consent;
- material that promotes the use of illegal drugs or encourages the use of ammunition, fireworks or any destructive device or explosive;

- material advertising gambling and betting.

When using the Services, you also agree not to
- defame, abuse, harass, stalk, threaten, bully or otherwise violate the legal rights of others;
- violate any applicable laws or regulations or support or encourage any illegal activity;

- take any action that imposes or may impose an unreasonable or disproportionately large load on NAILACADEMY's (or its affiliates' or third party providers') infrastructure (as determined in NAILACADEMY's sole discretion);

- engage in fraudulent transactions;
- create more than one account to participate in our Services;
- use the Services for betting or gambling of any kind;

NAILACADEMY reserves the right, but has no obligation, to monitor or become involved in disputes between you and other Users (including speakers of the Course) and use your common sense and best discretion when interacting with others, including posting or publishing content or personal information or other information. You also acknowledge that you are responsible for all data obligations you incur through the use of our Services.

You acknowledge that NAILACADEMY owns or has a license to all right, title and interest in and to the "Content" made available through the Services.

NAILACADEMY reserves all rights to the Content other than the rights specifically listed herein as licensed to you. You are only permitted to use the Content as expressly authorized by NAILACADEMY.

By using the Services, you agree, represent and warrant that you will not engage in, permit any other person or entity to engage in, or otherwise be associated with or a part of, the following restricted activities:

You are responsible for ensuring that the User Submitted Content You provide does not infringe any third party rights, and You agree to be liable for any such infringement and agree to indemnify NAILACADEMY against any third party claims.

NAILACADEMY RESERVES THE RIGHT TO TERMINATE USER ACCOUNTS THAT ARE INACTIVE FOR AN EXTENDED PERIOD OF TIME. NAILACADEMY RESERVES THE RIGHT TO MODIFY THE SERVICE (OR ANY PART THEREOF) TEMPORARILY OR PERMANENTLY, WITH OR WITHOUT NOTICE. You agree that any claim arising out of or relating to your relationship with NAILACADEMY must be made within one year after such claim arises or your claim will be permanently time-barred.

If you have any complaint, claim or dispute in relation to the Website and/or the Services, you must submit such complaint in writing to NAILACADEMY as soon as possible after the occurrence of the event referred to in the complaint. You must comply with all applicable laws, statutes, ordinances and regulations regarding your use of the Website and the Services. Although the Services are accessible worldwide, NAILACADEMY makes no representation that materials in the Services are appropriate or available for use in locations outside of Turkey, and access to such materials from territories where their contents are illegal is prohibited. Those who choose to access the Services from other locations do so on their own initiative and are responsible for compliance with local laws where and to the extent local laws apply.

Notices to you may be sent to the e-mail or postal address you provide as part of your account or user profile, if any. This Agreement constitutes the entire agreement and understanding between you and NAILACADEMY with respect to its subject matter and supersedes all prior agreements and understandings of the parties with respect to such subject matter.

No Waiver
If you breach these Terms or any of our policies and NAILACADEMY takes no action, NAILACADEMY will still be entitled to exercise its rights and remedies in any other situation where you breach these Terms of Use.

Severability
If any part of these Terms of Use is determined to be invalid or unenforceable, the invalid or unenforceable provision shall be deemed to be superseded by an enforceable provision that most closely approximates the intent of the original provision, and the remainder of these Terms of Use shall continue in full force and effect.

Force Majeure
You acknowledge and agree that in no event shall NAILACADEMY be liable for any event beyond our reasonable control (including but not limited to acts of any government or authority, embargo, revocation of any license or approval, failure of any power supply, theft, malicious damage, act of war, terrorism, acts of God, internet outages and similar force majeure events).

Nothing in this Agreement shall be construed as creating any agency, arrangement, partnership, joint venture, fiduciary relationship, employer-employee relationship or any similar relationship between you and NAILACADEMY.

Nothing contained in this Agreement violates NAILACADEMY's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Services or information provided to or collected by NAILACADEMY in connection with such use.
